These Terms and Conditions explain the general rules for using our website and booking photography or related services from Chic Dion Photography, LLC. Please read them before submitting an inquiry, purchasing a service, or using this website.

Your signed agreement comes first.

Every booking may include a proposal, invoice, questionnaire, model release, and photography contract through HoneyBook. If a signed agreement conflicts with these general website terms, the signed agreement controls that booking.

Agreement and Eligibility

By accessing this website, submitting an inquiry, purchasing a product, or booking services from Chic Dion Photography, LLC, you agree to these Terms and Conditions and our Privacy Policy.

You must be at least 18 years old and legally able to enter a contract to book services. If you book for another person, family, organization, school, team, business, or event, you represent that you have authority to do so.

Website Use

This website and its text, branding, design, photographs, videos, graphics, and other content are provided for personal and informational use. You may not copy, scrape, republish, sell, modify, distribute, frame, reverse engineer, or commercially exploit website content without written permission.

You may not interfere with the website, attempt unauthorized access, submit harmful code, misuse forms, impersonate another person, or use the website for unlawful, fraudulent, abusive, or harassing activity.

Quotes, Proposals, and Booking

Website prices and service descriptions are general information and may change. A date is not reserved by an inquiry, consultation, verbal discussion, social-media message, unsigned proposal, or unpaid invoice.

Unless a signed agreement states otherwise, a booking becomes official only after Chic Dion Photography, LLC receives the signed contract and required 30% non-refundable retainer. Availability is offered on a first-completed-booking basis. Proposals may expire on the date shown in the proposal.

Retainers, Invoices, and Payments

A 30% non-refundable retainer is required to reserve a date. The retainer compensates Chic Dion Photography, LLC for holding the date, turning away other work, and beginning planning. It will not be refunded if the client cancels, changes plans, arrives late, shortens coverage, or no longer needs the services. If applicable law or the signed agreement requires a different result, those requirements control.

Remaining balances, installment dates, accepted payment methods, late fees, and other payment terms are listed in the client’s proposal, invoice, or signed agreement. Final images, galleries, downloads, products, or usage rights may be withheld until all required payments are received.

Clients should contact us promptly about billing questions. Unauthorized chargebacks or payment reversals may be disputed using the signed contract, communications, delivery records, and other booking documentation.

Pricing, Taxes, Travel, and Additional Costs

Final pricing depends on coverage time, location, travel, the number of photographers or videographers, products, add-ons, permits, taxes, and other details listed in the proposal. Colorado sales tax and other required taxes may be added where applicable.

Travel fees may apply outside the included service area and may cover mileage, parking, tolls, airfare, baggage, lodging, meals, rental transportation, or other reasonable costs. Additional coverage requested before or during an event is subject to availability and may require additional payment.

Cancellation, Rescheduling, and Day-of Delays

Cancellation and rescheduling requests must be made in writing. Retainers, rescheduling fees, credits, replacement dates, and amounts due are handled according to the signed contract. A new date is subject to availability and is not confirmed until both parties approve it in writing.

Coverage begins and ends at the times listed in the signed agreement. Chic Dion Photography, LLC is not required to extend the contracted end time because a client, participant, guest, vendor, ceremony, reception, transportation, or venue is late; the timeline or location changes; plans change; or another day-of issue causes a delay. Delays may reduce the number of locations, poses, events, or finished images that can reasonably be captured.

Additional coverage is available only if Chic Dion Photography, LLC agrees, the schedule allows it, and the client accepts the applicable overtime charge. Extra time is not guaranteed and will not be provided without charge to replace time lost because of a client-controlled or event-related delay.

Weather, Locations, Access, and Permits

Outdoor photography depends on weather, light, public access, venue rules, traffic, closures, crowds, and other changing conditions. We may recommend adjusting the location, schedule, or session plan for safety or image quality.

Unless the proposal says otherwise, the client is responsible for securing required location permission, tickets, permits, parking, and venue access. Chic Dion Photography, LLC is not responsible when a location, venue, park, property owner, officiant, or event coordinator limits or prevents photography.

Client Responsibilities

Clients agree to:

  • Provide accurate contact, date, location, timeline, and event information.
  • Disclose important restrictions, accessibility needs, and safety concerns.
  • Obtain any permission needed for private property, venues, or participants.
  • Inform guests and participants that photography or video may take place.
  • Provide a reasonable working environment and follow agreed schedules.
  • Download, review, and back up delivered files before gallery expiration.

The client is responsible for the cooperation of family members, guests, wedding parties, children, pets, teams, or other participants. Specific images cannot be guaranteed when subjects are unavailable, late, unwilling, or unable to participate.

Safety, Respectful Conduct, and Working Conditions

Chic Dion Photography, LLC may pause, relocate, or end services if conditions become unsafe, illegal, threatening, abusive, discriminatory, or damaging to people or equipment. This includes severe weather, dangerous terrain, unsafe animals, harassment, violence, intoxicated behavior, or instructions that require unsafe actions.

If services end because of client or guest conduct, fees and refunds will be handled under the signed agreement and applicable law.

Creative Style, Coverage, and Editing

By booking, the client acknowledges familiarity with the artistic style shown in our current portfolio. Chic Dion Photography, LLC retains creative judgment over lighting, posing, composition, camera settings, image selection, color, cropping, editing, and the final presentation of delivered work.

We do not guarantee an exact recreation of another photograph, location, weather condition, pose, trend, editing style, or complete shot list. We make reasonable efforts to capture requested people and moments, but events are unpredictable and no specific image is guaranteed unless expressly agreed in writing.

Standard editing may include color and exposure correction, cropping, and reasonable retouching consistent with our style. Extensive manipulation, body modification, object removal, compositing, or additional revisions may be declined or quoted separately. RAW and unedited files are not included unless expressly listed in the signed agreement.

Delivery, Online Galleries, and File Storage

Delivery estimates are listed in the proposal or contract and may vary with season, event size, products, revisions, emergencies, or technical issues. Any preview or estimated delivery date is not a guarantee unless the signed agreement specifically states otherwise.

Finished images are generally delivered through a private online gallery such as CloudSpot. Gallery links and passwords should be protected. The client is responsible for downloading and backing up files before the gallery expiration date listed in the contract, email, or gallery notice.

We do not promise permanent storage. Restoration, re-uploading, or extended gallery hosting may not be available and may require an additional fee. Product color and cropping may vary slightly among screens, labs, printers, materials, and display conditions.

Portfolio Use and Model Releases

Permission to display photographs or video in our portfolio, website, social media, advertising, publications, competitions, educational materials, or studio samples is governed by the client’s signed contract or model release. These general website terms do not replace a specific release or restriction agreed in writing.

A parent, guardian, school, team, or authorized organization must provide any permission required for identifiable minors when applicable.

Third-Party Platforms, Products, and Links

We may use services such as Squarespace, HoneyBook, CloudSpot, payment processors, print laboratories, delivery companies, email providers, and other vendors. Their availability, terms, security, shipping, and performance are partly outside our control.

Links to outside websites are provided for convenience and do not mean we control or endorse all third-party content. Third-party purchases may also be subject to that provider’s terms, privacy policy, warranty, and return policy.

Reviews and Feedback

Clients are free to share honest reviews and opinions about their experience. Nothing in these Terms prohibits or penalizes a truthful consumer review. Reviews must not knowingly include false statements, unlawful content, harassment, private information belonging to others, or copyrighted material the reviewer does not have permission to post.

Events Outside Our Reasonable Control

Neither party is responsible for delay or failure caused by events outside reasonable control, including severe weather, wildfire, natural disaster, illness, injury, government order, road closure, venue closure, power or internet failure, labor disruption, transportation interruption, equipment theft, or other emergencies.

The parties will make reasonable efforts to communicate and find a fair solution, such as rescheduling, replacement coverage, substitute services, credits, or refunds of unearned amounts, as described in the signed agreement and required by applicable law.

Limitation of Liability

To the fullest extent permitted by law, Chic Dion Photography, LLC is not responsible for indirect, incidental, special, punitive, or consequential losses, including lost profits, missed opportunities, emotional distress, or losses caused by third-party services.

If files are lost, damaged, or undeliverable because of equipment failure, corruption, theft, accident, or another cause despite reasonable care, any remedy will be determined by the signed agreement and applicable law. To the fullest extent permitted by law, total liability relating to a specific booking will not exceed the amount the client paid Chic Dion Photography, LLC for the affected service.

Nothing in these Terms excludes rights or remedies that cannot legally be waived or limited.

Governing Law and Disputes

These Terms are governed by the laws of the State of Colorado, without overriding consumer rights that must apply under another law. Before filing a formal claim, the parties agree to make a good-faith effort to discuss the issue and seek a reasonable solution.

Where legally permitted, disputes relating to these Terms or services will be handled in the appropriate courts serving El Paso County, Colorado. A signed client contract may include additional dispute procedures that control that booking.

Changes, Severability, and Waiver

We may update these website Terms when our services, tools, or legal obligations change. The updated date will appear at the top of the page. Changes do not rewrite an existing signed client contract unless both parties agree as required by that contract and applicable law.

If one portion of these Terms is found unenforceable, the remaining portions will continue to apply to the extent permitted by law. A delay in enforcing a term does not permanently waive the right to enforce it later.
